Asbestos Testing in New York

New York is one of the most survey-driven states: Industrial Code Rule 56 (12 NYCRR Part 56) puts the asbestos survey on the building owner before most demolition, renovation, remodeling, or repair. New York City layers its own DEP program on top.

Agency: NYS Department of Labor (DOL) Asbestos Control Bureau; NYC Department of Environmental Protection (DEP) Asbestos Control Program inside New York City

The NYS DOL Asbestos Control Bureau enforces Industrial Code Rule 56, which covers contractor licensing, worker certification, notifications for large projects, building surveys, and abatement methods. If your project is in the five boroughs, the NYC DEP Asbestos Control Program adds city forms and city-certified investigators.

Is an asbestos survey required before my project?

Under Rule 56 §56-5.1(a), an owner or owner’s agent must have an asbestos survey completed by a licensed asbestos contractor using certified inspectors before demolition, renovation, remodeling, or repair work begins. The rule excepts “the owner of one and two-family dwellings who contracts for, but does not direct or control the work.” §56-5.1(b) exempts agricultural buildings, buildings whose original construction began on or after January 1, 1974, and structures certified in writing as structurally unsound. Exemptions do not remove EPA or OSHA inspection duties (§56-5.1(d)). Source: 12 NYCRR Part 56 (PDF).

Who has to be licensed or certified

Rule 56 §56-3.1(b) requires firms working as abatement contractors, management planners, project designers, project monitors, allied trades, inspectors, or air sampling monitors to hold a DOL asbestos handling license, and their employees to hold the matching asbestos certificates. A handling license is valid for one year. Certificate applications are handled online through DOL’s MPWR system. Sources: Rule 56, DOL Licensing and Certification.

Air sampling and lab rules (why independence matters)

Project air sampling must be done by a certified asbestos project air sampling technician (§56-4.1). Air and bulk samples must go to a lab approved by the NYS Department of Health Environmental Laboratory Approval Program (ELAP) for the method used (§56-4.2). And §56-4.3 requires a third-party air sampling firm, contracted by the property owner or owner’s agent, that is completely independent of every abatement contractor on the project. Project size and DOL notification

Rule 56 defines a large asbestos project as 160 square feet or more, or 260 linear feet or more, of ACM/PACM; a small project is more than 10 and less than 160 square feet, or more than 25 and less than 260 linear feet. For a large project, the abatement contractor’s written notification must reach the Asbestos Control Bureau at least 10 calendar days before Phase IIA begins, with a nonrefundable fee (emergency procedures differ). Homeowners

Rule 56 states that it does not apply to owner-occupied single-family dwellings where the owner performs the work. DOL also publishes an Asbestos Abatement Homeowner Exemption FAQ (P229). A homeowner who hires a contractor should read the survey section above carefully. Source: Rule 56 §56-1.3.

New York City (DEP) layer

In NYC, building owners are responsible for having a DEP-certified asbestos investigator survey whether ACM will be disturbed, documented on an Asbestos Assessment Report (ACP-5). DOB will only issue a full demolition permit based on an ACP-5 with box 8d checked (entire building free of ACM). Work disturbing more than 25 linear feet or more than 10 square feet of ACM is an “asbestos project” and needs an ACP-7 notification filed in ARTS at least one week before work starts. DEP certifies asbestos investigators, handlers, and supervisors. Sources: NYC DEP asbestos abatement forms, DEP certification applications.

Look up a contractor or a filed project

DOL publishes an Asbestos Contractors Listing and lists of notified asbestos projects, linked from the Asbestos Control Bureau page. In NYC, ACP-5 and ACP-7 filings for a property can be searched in the DEP ACP Search Portal.
